PRIVACY NOTICE

1. Introduction

This Privacy Notice (Notice) explains how Winner’s Marketing, Inc., and its affiliate Funambulist Gaming, LLC (Funambulist, Winner’s, we, our, or us), together with its subsidiaries and affiliates, collect, use, disclose, and otherwise process Personal Data as we provide, and as you use or interact with, our Services. This Notice also explains your privacy rights and options with regard to your Personal Data. If you have questions about our privacy practices, please contact us using the information provided below in the Contact Us part of this Notice.

2. Our Services
Funambulist provides promotional, prize, consumer-support, and related business services through our websites, platforms, online tools, communications, and offline business activities (collectively, the Services). Our Services may involve working with Funambulist customers (our direct customers); our consumers, Site visitors, players, individual contacts, and/or claimants (collectively, consumers); and other individuals who interact with us or with our customers and partners. Our Services are described in our Terms of Use, on our websites (the Site or Sites), and in this Notice. This Notice is subject to our Terms of Use, and some Services mentioned in this Notice may not be available at all times. If you do not agree to the Terms of Use or this Notice, you must discontinue using the Services.
3. What is Personal Data?

In this Notice, Personal Data, Data, or Personal Information refers to information that identifies or can reasonably be associated with or linked (directly or indirectly) to an individual. Certain laws may define Personal Data to include information that could identify or be linked to a specific household or device. Generally (except in California), Personal Data excludes information exchanged when a person acts within their role as an employee or representative of an organization.

Anonymous statistics and de-identified information are generally not considered Personal Data because they do not identify individuals. Publicly available information is also not protected as Personal Data.

4. Data Minimization and Use
Funambulist seeks to collect and use Personal Data in a manner that is reasonably necessary and proportionate to provide, support, improve, secure, and market our Services; operate our business; comply with legal, tax, regulatory, and contractual obligations; and carry out the purposes described in this Notice. Funambulist does not “sell” Personal Data for monetary or other valuable consideration, and we do not use Personal Data to train artificial intelligence or large language models. We do share Personal Data with third parties for third-party advertising technology purposes, so that we may provide you with more relevant advertising when you visit other websites and mobile applications.
5. When Does this Notice Apply to Your Personal Data?

Unless otherwise indicated, we follow the policies outlined in this Notice with respect to Personal Data obtained from or about individual consumers in the United States through our Services. In certain cases, Funambulist may provide different or additional notices about our data practices. For example, if you reside in a U.S. state with a consumer privacy law, Section 16 of this Notice applies to you in addition to the rest of this Notice.

This Notice applies when Funambulist acts as the “Controller” of the Personal Data we collect through our Services, both online and offline (a Controller is also identified as a “business” under California law). It does not apply to Data our customers collect and share with us where we act as a “Processor” or “Service Provider” on the customer’s behalf. This Notice explains certain practices where Funambulist processes Personal Data as a service provider or processor for customers, affiliates, subsidiaries, and other business partners, to the extent we are permitted or required to explain those practices here.

When Funambulist processes Personal Data on behalf of a customer or other organization, that organization may control the Data and determine how it is used, stored, and retained. For example, we may process information relating to a customer’s consumer contacts, consumers themselves, our customers, or other individuals to provide Services to our customer. In those cases, privacy requests concerning that Data should generally be directed to the organization that collected or controlled the Data, and we will assist that organization as required by applicable law and our agreements.

Our Site may contain links to other websites, applications, and services from third parties. We are also present on social media, and you may see content about Funambulist elsewhere on the Internet. Funambulist does not own or control these third-party sites, which are controlled and managed by the website owner. The privacy and data-security practices of third-party sites are governed by the privacy policies of those third parties, and not by Funambulist.

6. Funambulist’s Relationship with You
Different categories of Data are collected and processed differently based on the relationship we have with you. The relationship we have with a Site visitor, consumer, customer, customer contact, business partner, employee, worker, contractor, or service provider may differ depending on the context of the interaction. Note: Personal Data collected from Funambulist customers in the business-to-business (B2B) context is generally not subject to consumer privacy laws or the consumer privacy rights described in this Notice, except as required by the CCPA for California residents.

Consumers: Site Visitors, Claimants, Players, and Individual Contacts

Funambulist acts as a Controller when you visit our public-facing Site or otherwise interact directly with us in your personal capacity, such as when you contact us by phone, email, chat, text, web form, social media, mail, or other means; participate in a promotion; provide player or prize-related information; submit tax forms; or otherwise use our Services directly.

Business Contacts

If you interact with Funambulist or its Services on behalf of an organization, such as your employer, a Funambulist customer, a supplier, or a business you own or manage, that organization may be the Controller and Funambulist is likely acting as a Processor or service provider. Any Personal Data generated during these interactions may be part of that organization’s account or relationship with us and thus governed by that organization’s policies. Please direct privacy inquiries about that organization’s Data to the organization’s administrator or privacy contact.

Employees, Job Applicants, Workers, and Contractors

If you are a Winner’s (or Funambulist) employee, job applicant, contractor, or other worker, we may collect Data in that capacity for recruiting, onboarding, payroll, benefits, tax, compliance, security, and related human-resource business purposes (HR Data). Internal workforce policies or notices govern how Winner’s processes HR Data and will provide additional information. This Notice does not apply to Winner’s HR Data.
7. Children and Teens Under 18
Our Services are not geared toward or intended to solicit, collect, or process Personal Data from any individual under the age of 18, and we do not knowingly collect, sell, or share the Personal Data of anyone under the age of 18. Our Services relate to skill-game and prize activities that are restricted to adults, and we do not direct any Services to minors. Please contact us using the information in the Contact Us section of this Notice if you believe Data regarding your child or teen under 18 has been collected by us through our Services.
8. Information We Collect About You and How We Collect It

Some of the information we collect is personal to you. Other information is anonymous or de-identified. To learn more about your choices for the collection, use, and disclosure of Personal Data, please see Section 11 of this Notice. If you reside in a U.S. state with a consumer privacy law, Section 16 also applies to you.

We collect the following categories of information:

Identifying and Contact Information

We collect this type of Data when someone chooses to share it with us, for example:

  • When you create or use an account, submit a request, participate in a promotion, claim a prize, or interact with our Services, you may provide your name, email address, phone number, mailing address, organization, account details, login credentials, security-question answers, and other identifiers.
  • When you contact us by online form, email, mail, phone, chat, text, or social media, we may keep a record of the message or conversation, including your contact information, the reason you contacted us, chat contents, attachments, and any comments or information you provide.
  • We may receive information when you post on a third-party service where we have a profile or presence, such as social media, or when you interact with our advertising, marketing, or social media content.
  • We collect information from other interactions you may have with us, such as when you respond to a survey, provide Data to learn about our Services, submit consumer or prize information, provide W-9 or tax information, report a problem with our Services, or communicate with our support team.
  • We may also collect information about the device you use to access our Services and your interactions with our Services, including identifiers, browser or device information, and activity information.

Device, Usage, and Internet or Other Network Activity Information

This type of Data is collected when you browse our Sites, use online Services, interact with our ads or social media content, or open our emails. It may include technical information such as your IP address, mobile network details, device ID, browser and device type, pages viewed, links clicked, referring websites, advertising interactions, and details about what you viewed. We and our service providers, affiliates, subsidiaries, vendors, and customers may collect Personal Data in a variety of ways, including:

  • Through websites, portals, applications, support and chat tools, forms, emails, cookies, and other online or device-based tools that provide you with access to our Services;
  • Offline, such as when you contact customer service, submit documentation, provide tax or payment information, communicate with a Funambulist representative, or otherwise interact with us outside the Site; and
  • From other sources, such as customers, affiliates, subsidiaries, service providers, advertising and marketing partners, social media platforms, public databases, business-information providers, and legal or regulatory sources.

Business, Commercial, and Customer Information

We may collect commercial and business information that may include Personal Data, including customer records, business/location data used for marketing, contracts, order information, invoices, payment records, prize and promotion information, consumer contact and W-9 fields, customer account information, vendor or supplier information, and records of products or services purchased, obtained, considered, or provided. Note: Much of this information relates to customers and other business contacts and is collected in a B2B context. B2B data is generally not subject to consumer privacy laws except where required by the CCPA for California residents. See Section 16.B for more information.

Account Credentials

Where such services are used now or in the future, we will collect usernames, passwords, security-question answers, account-access credentials, and other authentication information to protect our Services and your security, to the extent permitted or required by applicable law. We will not use this Data for the purpose of inferring characteristics about you.

Tax, Financial, Compliance, and Sensitive Information

We may collect, where required by law, certain financial information such as W-9 information, driver’s license numbers, Social Security numbers, bank account and routing information, financial account information, tax-reporting information, and other information needed for payment, tax, prize, compliance, fraud-prevention, and legal purposes. We do not use or disclose sensitive Personal Data for the purpose of inferring characteristics about you.

Location Information

We can generally detect where the Site is accessed from based on an IP address, which gives us a general idea of device or network location, such as country, city, or ZIP code. We may also collect general location information such as ZIP code, operator location, or service location to assist in the provision of our Services.

Personal Data You Disclose Relating to Others

If you disclose Personal Data relating to other people to us or to our service providers in connection with the Services, you affirmatively represent that you have the authority to do so and to permit us to use that Data in accordance with this Notice. You must first inform the other individual and obtain that individual’s consent before disclosing their Data to us. You may NOT consent on behalf of another person.

Employee, Worker, and Contractor Information

This Notice does not apply to any Winner’s HR Data. HR Data submitted to Winner’s, or relating to employees, former employees, candidates, or contractors, is governed by Winner’s internal employee and human-resource policies.

9. Sources of Data and Purpose for Use

This section outlines the sources and purposes for collecting the categories of Personal Data described in Section 8 above. To learn more about your choices, please see Section 11. If you reside in a U.S. state with a consumer privacy law, Section 16 also applies to you.

Overview of our Data Sources

We collect Data from a variety of sources, including but not limited to:

  • Directly: from the person who is the subject of the Personal Data.
  • Indirectly: from service providers, affiliates, subsidiaries, customers, public databases, advertising and marketing partners, social media platforms, legal and regulatory sources, and interactions related to us on third-party services where we have a profile or presence.
  • Automatically: (directly or indirectly) from the device used when you visit the Site, your network, emails, ads, social media interactions, cookies, pixels, tags, beacons, analytics tools, and other online technologies.

Overview of our Data Use

Our main goals in collecting Data are to provide, support, improve, secure, and market our Services; support our customers and business partners; administer promotions, prizes, payments, and tax reporting; maintain business records; comply with legal and regulatory obligations; and better understand how our Services and marketing perform. We use Personal Data for purposes including the following:

Product, Services, Promotion, and Customer Fulfillment

  • Communicate about the Services, promotions, prizes, customer matters, support requests, feedback, and other interactions related to the Services;
  • Set up, administer, and support consumers, accounts, portals, customer records, finance records, support tickets, and other Service-related records;
  • Process, verify, and administer payments, prize claims, tax forms, W-9s, bank account and routing information, and related financial or compliance documentation; and
  • Provide, maintain, enhance, and evaluate our Services, marketing, advertising, reporting, and customer support.

Internal Operations

  • Improve our Services, marketing, systems, vendors, and operations;
  • Strategize, analyze, and plan Site content, marketing campaigns, location performance, customer support, and business development; and
  • Improve the effectiveness, security, accuracy, reporting, and availability of our systems and Services.

Security, Compliance, Legal Obligations, Tax, and Fraud Prevention

  • Detect, investigate, and prevent activities that may be illegal or violate our policies;
  • Protect our assets (online and offline) and prevent fraudulent activities;
  • Validate credentials, authenticate logins, verify identity, verify tax and payment information, and confirm eligibility where appropriate;
  • Protect the security and integrity of our Services and our Data; and
  • Assist law enforcement, regulators, courts, tax authorities, auditors, and other legal or regulatory recipients, if necessary.

Anonymized or De-Identified Uses

  • To the extent we anonymize or de-identify Data, we will not attempt to re-identify it.

Information You Provide Directly to Funambulist

The Data mentioned above is generally collected directly from the individuals the information is about, from organizations acting on their behalf, or from customers that provide Data for our Services. For example, we may collect information you share with us via email, phone, chat, account or profile details, finance or support portals, forms, tax documents, customer records, prize-claim materials, or other communications. If we request Personal Data, the purpose will be explained at the time of request unless it is obvious from the context. If you do not want to share your information, you can choose not to participate in a particular Service or activity.

Information from Your Device

We and third parties we hire to provide services — such as Site hosting, management, and development; web form and Site content management; Site security services; embedded content hosting; analytics and advertising; marketing; customer support; document management; and other technology services — may automatically collect Data from your device when you use our Services. Data-protection laws in some jurisdictions may consider this Data to be Personal Data.

Collecting this information helps us better understand visitors who come to our Site, how our marketing and advertising perform, how our Services are used, and what content interests visitors. This Data is used for internal analytics, marketing, advertising, security, fraud-prevention, and service-improvement purposes.

Social Networking Plugins and Platforms

When you use social networking platforms (such as YouTube, LinkedIn, Instagram, Facebook, TikTok, X, or similar platforms) and plugins on our Services, certain Data may be shared with that platform. By using these platforms and plugins, you are sharing your Data with that platform, and that platform’s privacy notice governs its use or disclosure of that Data. Social media platforms and advertising partners may also collect information about your activity on our Site or across the Internet and use it to deliver targeted advertising or measure advertising effectiveness. Those third-party privacy notices apply to that tracking activity, and we encourage you to read them.

Third-Party Online Advertisers and Ad Partners

Analytics and advertising providers, including Google or similar providers, may use Data collected through tools operating on our Site to identify and examine how our Site is used, create reports on Site activities, measure marketing or advertising effectiveness, and share those reports with us. Our Site uses a consent-management platform to gate analytics and advertising technologies behind user consent where required. Google, Inc. may seek to contextualize and personalize ads within their own advertising networks or services based on visits to our Site and other activity on the Internet. Their privacy notices apply to that activity, and we encourage you to read them.

10. How and Why Funambulist Discloses Your Personal Data

This section describes when and to whom we disclose the categories of Personal Data described in this Notice. Funambulist does not sell Personal Data for money. We may disclose, make available, permit, or share Data with others in the circumstances described below, including for service, marketing, advertising, analytics, operations, payment, tax, compliance, legal, and security purposes.

We may disclose “blinded” aggregated data and user statistics without restriction. Blinded data is data that does not identify an individual.

To Customers, Affiliates, Subsidiaries, and Business Partners

We may disclose Data to customers, affiliates, subsidiaries, business partners, and other organizations in connection with our Services, including to support marketing, promotions, prize administration, payments, location operations, reporting, customer support, and compliance. If Data is controlled by one of those organizations, privacy questions about that Data should be directed to that organization.

Targeted Advertising, Marketing, and Social Media Tracking

Funambulist uses social media advertising, marketing pixels, cookies, analytics, and similar technologies to measure marketing performance, understand Site activity, and deliver or help deliver targeted advertising or other marketing. We do not sell Personal Data for monetary or other valuable consideration. However, some State Privacy Laws treat certain targeted advertising, cross-context behavioral advertising, or disclosures to advertising or analytics partners as a “sale,” “sharing,” or processing for targeted advertising. To learn more about your Data choices, see Section 11. If you reside in a U.S. state with a consumer privacy law, Section 16 also applies to you.

To Service Providers, Vendors, and in Special Cases

Funambulist and our service providers, vendors, affiliates, and subsidiaries may disclose, access, or monitor Personal Data in special cases and for ordinary business purposes. These recipients may include affiliates or subsidiaries such as Funambulist; web developers and Site vendors such as TechArk; customer-relationship and sales tools such as Pipedrive; contract and e-signature tools such as GetAccept; finance portals; cloud storage and collaboration tools such as SharePoint and Dropbox; gaming, promotional, and operational platforms; customer-support tools such as Zendesk; accounting providers; shipping and fulfillment providers such as FedEx; customers; legal advisors; regulators; courts; tax authorities; law enforcement; and other legal or regulatory recipients. Examples include:

  • When we believe we must disclose Data to identify, contact, or bring legal action against someone who may be causing injury to or interference with our rights or property, our consumers or customers and their Data, or anyone else who may be harmed by such activities;
  • When we believe in good faith that the law requires it;
  • For administrative, operational, payment, tax, marketing, advertising, analytics, support, and security purposes we deem necessary to maintain, service, and improve our Services and business, including through third-party partners and service providers we use to host, develop, secure, support, analyze, advertise, market, process payments, ship, print, store, document, and manage our Services and Data; and
  • In the event Funambulist buys, sells, merges, reorganizes, transfers, or finances businesses or assets, in which case Personal Data may be a transferred business asset or may be disclosed in connection with the proposed transaction. In such a case, the transferred Data may become subject to a different privacy notice.
11. Your Choices About Collection, Use, and Disclosure of Your Personal Data

This section provides information about your choices for the collection, use, and disclosure of your Personal Data. If you reside in a U.S. state with a consumer privacy law that applies to you and to us, Section 16 below provides additional information about your choices, including how to exercise your privacy rights.

A. Managing your Data Preferences with Us

i. Revoking Consent

If we are collecting, using, or disclosing Personal Data with your consent, you can withdraw consent to future use of your Personal Data at any time by contacting us using one of the methods in the Contact Us section below. Withdrawing consent will not affect processing that occurred before withdrawal, nor use of Data on grounds other than consent — for example, when we use cookies to present Site content, maintain security, support requested Services, or comply with legal obligations.

ii. Account Information

You may be able to manage certain Data stored within your account, portal, or profile by logging in and viewing, changing, or deleting that information. If your information is controlled by a customer, employer, or other organization, please contact that organization to change account information, credentials, or records it controls.

iii. Information Associated with an Email Address

To manage the Data associated with your email address in our systems, please contact us using a method in the Contact Us section of this Notice.

iv. Promotional Communications

You may opt out of receiving recurring marketing communications from us by following the instructions in each marketing email or subscription service, using any unsubscribe link provided, or contacting us using the methods in the Contact Us section. If you opt out, we may still send non-promotional messages, such as messages about transactions, accounts, prizes, payments, tax forms, compliance, security, or ongoing business relationships.

v. SMS Messaging

You expressly agree and consent to Winner’s Marketing, Inc. and its affiliate Funambulist Gaming, LLC sending informational text messages regarding their systems and services, including technical support, consumer assistance, prize or claim assistance, and related service issues. Such text messages may be sent directly by us. Your consent is not required to obtain any good or service. This consent applies, and you may still be contacted, even if your number appears on the National Do-Not-Call Registry or any other Do-Not-Call list. Message and data rates may apply. No mobile opt-in or text-message consent will be shared with third parties. Please see Section 16.C below for more information regarding the types of Personal Data collected.

If you believe inaccurate or inappropriate information has been obtained or provided through your use of our Services, please contact a representative of Funambulist using one of the methods in the Contact Us section of this Notice.

B. Automatic Browser Signals to Communicate User Preferences

The Global Privacy Control Browser Opt-Out Preference Signal

The Global Privacy Control (GPC) is an option you can configure in your browser’s settings (or by downloading a browser extension, for certain browsers) to signal to websites that you want to limit Data sharing as much as possible. Our Site recognizes and honors GPC signals through our consent-management platform. When a GPC signal is detected, our Site automatically applies an opt-out consent state for sale, sharing, and targeted-advertising purposes without requiring banner interaction. To learn more about your choices, see Section 16.

Do Not Track Codes

Some web browsers offer a “do not track” (DNT) privacy-preference setting. Our Site does not currently support DNT codes. When you turn on DNT settings in your browser, your browser sends a signal to websites, analytics companies, ad networks, and other web services requesting those tools to stop tracking and sharing your activity. Web browsers supporting DNT provide instructions on how to enable it; search for instructions in your browser’s help section.

12. What Security is in Place to Protect Against Loss, Misuse, or Alteration of Data?

Because information sent through the Internet travels from computer to computer throughout the world, information you provide may be sent to servers outside the country where you originally entered it. While no data transmission over the Internet can be guaranteed to be 100% secure, our Site uses encryption to protect the Personal Data we process. You can identify TLS in use on a page within our Site by the padlock symbol or “https” in the URL.

Information you disclose while using our Services, such as by posting a public review or using email, may potentially be collected and used by others. This may result in unsolicited messages from third parties or misuse of your information for various purposes, legal or illegal. While we strive to protect your Personal Data, we cannot ensure or warrant the security of any information you transmit to us or from our Services, and you do so at your own risk. If we receive a nonpublic transmission from you, we use commercially reasonable efforts to ensure its security on our systems. We endeavor to limit access to Personal Data to those who reasonably need it to provide and improve our Services and process your information appropriately.

13. How Long do we Keep Your Personal Data?

Funambulist maintains a documented and reasonable data-retention policy based on the needs and requirements for providing the Services. We retain Personal Data only for as long as reasonably necessary to carry out the purposes for which it was collected; comply with legal, tax, accounting, regulatory, and contractual obligations; resolve disputes; enforce agreements; maintain security; and support the legitimate business needs disclosed in this Notice.

The length of time we retain Personal Data is determined based on criteria such as the type and sensitivity of the Data, the purposes for which it was collected, the length of time the Data remains relevant, legal or regulatory retention periods, contractual obligations, limitation periods, and security and fraud-prevention needs. When we have no ongoing legitimate business need to process Personal Data, we will delete, anonymize, de-identify, or securely store and isolate it from further processing until deletion is possible, consistent with our retention policies.

14. U.S. Processing and Service Providers
This Notice is intended for individuals in the United States. Our Services, systems, service providers, affiliates, subsidiaries, and vendors process Personal Data in the United States and in other jurisdictions as needed to provide, support, secure, and improve our Services. We take reasonable steps designed to protect Personal Data according to applicable law and this Notice.
15. What Else Should You Know About Your Privacy?
Please keep in mind that whenever you voluntarily disclose information online, that information is accessible to others. You are solely responsible for maintaining the secrecy of your passwords and any account information. Please be careful and responsible whenever you are online.
16. Privacy Rights for Residents of U.S. States with Applicable Privacy Law

A. U.S. State Privacy Laws

Residents of certain U.S. states may have rights (now or in the future) under privacy laws in effect in their state, such as the California Consumer Privacy Act (CCPA), Colorado Privacy Act, Connecticut Data Privacy Act, Delaware Personal Data Privacy Act, Indiana Consumer Data Protection Act, Iowa Consumer Data Protection Act, Kentucky Consumer Data Protection Act, Maryland Online Data Privacy Act, Minnesota Consumer Data Privacy Act, Montana Consumer Data Privacy Act, Nebraska Data Privacy Act, New Hampshire Privacy Act, New Jersey Data Privacy Act, Oregon Consumer Privacy Act, Rhode Island Data Transparency and Privacy Protection Act, Tennessee Information Protection Act, Texas Data Privacy and Security Act, Utah Consumer Privacy Act, Virginia Consumer Data Protection Act, and any other U.S. privacy law and implementing regulations (collectively, State Privacy Laws). Some of these laws may not take effect until a future date.

While consumers may be covered by an applicable State Privacy Law, some State Privacy Laws may not apply to Funambulist due to the scope of our business, the types of Data involved, statutory exemptions, or limited interactions with consumer residents in certain states. We will adhere to the privacy rights below to the extent they apply to you and to Funambulist.

In general, the State Privacy Laws provide (now or in the future) consumer state residents with rights to:

  • Confirm whether we process their Personal Data and access it (the Right to Know);
  • Delete certain Personal Data;
  • Correct inaccuracies in their Personal Data, taking into account the nature of the information and the Controller’s processing purpose (excluding Iowa and Utah);
  • Obtain a copy of their Personal Data (the Right of Data Portability);
  • Opt out of Personal Data processing for targeted advertising (excluding Iowa), sales, or profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah);
  • Provide consent prior to, revoke consent for, or limit or opt out of the processing of sensitive Personal Data where required by applicable State Privacy Laws; and
  • Certain rights to question profiling or automated decisions having legal or similarly significant effects (Minnesota only).

Funambulist may process sensitive Personal Data as described in this Notice, such as Social Security numbers, driver’s license numbers, financial account information, and chat contents where those contents include sensitive information. Funambulist does not make decisions based on algorithms, automated decision-making, or automated profiling that produce legal or similarly significant effects concerning you.

The exact scope of these rights varies by state, may change, and new privacy rights may become applicable as State Privacy Laws and implementing regulations are passed or amended. Funambulist works to maintain this Notice with accurate and relevant information about consumer rights and each State Privacy Law. Please check this section periodically for updates.

B. Privacy Rights for Business Contacts and Workforce Members

Most State Privacy Laws apply to U.S. consumers who are natural persons acting in their personal or household capacities. Some State Privacy Laws do not apply to Personal Data collected in business-to-business (B2B), workforce, or employment contexts, while the CCPA and certain other laws may provide rights or disclosures for those contexts. If you interact with Funambulist as a contractor, employee, worker, job applicant, business representative, customer contact, customer, vendor, or supplier, we will process privacy requests to the extent required by applicable State Privacy Laws and any exceptions that may apply.

To make inquiries or exercise rights based on your interactions with Funambulist in your personal capacity, or to submit a request in a B2B or workforce context where applicable law provides rights, you can contact us directly using one of the methods in the Contact Us section of this Notice.

C. Our Collection, Use, and Disclosure of Personal Data

As noted above, we collect certain Data that identifies, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a particular consumer. Personal Data does not include the following:

  • Publicly available information;
  • De-identified or aggregated consumer information; and
  • Information excluded from most State Privacy Laws’ scope, such as: personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), and the California Financial Information Privacy Act (FIPA); data collected in the B2B context (except for California consumers, as defined under the CCPA); and data collected in the employment context (except for California consumers, as defined under the CCPA).

Note: Certain items such as sales-tax IDs and operator licenses are collected from Funambulist customers and business contacts in the B2B context and are not consumer Personal Data subject to State Privacy Laws (except as required by the CCPA).

D. Right to Know and Data Portability

If you are protected by an applicable State Privacy Law, you have the right to request access and disclosure of certain information about our collection and use of your Personal Data and to have a copy of that Data (collectively, the right to know). Once we receive a request and confirm the identity of the requestor and the Data subject (see Section 16.F below), we will disclose the following, per the request:

  • The categories of Personal Data we collected about you;
  • The categories of Personal Data we are processing or have processed;
  • The categories of sources for the Personal Data we collected about you;
  • Our business or commercial purpose for collecting, selling, sharing, or otherwise processing the Personal Data;
  • A list of the categories of third parties with whom we have shared your Personal Data, if any, and the categories of Personal Data shared with each;
  • A list of the categories of Personal Data we disclosed about you for a business purpose, if any, identifying the categories of recipients that obtained each category; and
  • A copy (if requested) of the specific pieces of Personal Data collected and maintained, in a commonly used electronic format.

If you are protected by the Oregon Consumer Privacy Act or the Minnesota Consumer Data Privacy Act, you have additional rights to obtain a list of the specific third parties to which we have disclosed your Personal Data. Please indicate that you are an Oregon or Minnesota resident when you submit your request.

E. Right to Delete and Correct

If you are protected by an applicable State Privacy Law, you may have the right to request that we delete the Personal Data collected or maintained about you and to correct inaccuracies in that Data, subject to certain exceptions (collectively, the right to delete or correct). Once we receive a request and confirm identity (see Section 16.F below), we will review the request to determine whether an exception applies. We may deny a deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the Data, provide a requested good or Service, take actions reasonably anticipated within our ongoing business relationship with the consumer, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with the consumer;
  • Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for such activities;
  • Debug the Services to identify and repair errors that impair intended functionality;
  • Exercise free speech, ensure the right of a consumer to exercise their free-speech rights, or exercise another right provided for by law;
  • Comply with applicable state law, including the California Electronic Communications Privacy Act (Cal. Penal Code Sec. 1546 et seq.);
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to applicable ethics and privacy laws, when deletion may render the research impossible or seriously impair it, if informed consent was previously provided;
  • Comply with a legal obligation; or
  • Other purposes as permitted under State Privacy Law.

Upon receipt of a verifiable request, we will delete or de-identify and/or correct Personal Data not subject to an exception, and will direct our service providers to take similar action.

F. Exercising Your Privacy Rights

To exercise the rights to know or delete described above, please submit a request using one of the methods in the Contact Us section of this Notice.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Data. You may submit a request to know no more than twice within a twelve (12) month period. Your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data, or an authorized representative; and
  • Describe your request with sufficient detail to allow us to properly understand, evaluate, and respond to it.

Verifying Requests. We cannot respond to your request or provide you with Personal Data unless we verify your identity or authority and confirm the Data relates to you. For requests to know and delete, we will attempt to match your identity to Data in our records and may ask for additional information. The Data you provide will be used solely for identity-verification purposes.

Authorized Agents. You may designate an authorized agent to make a request on your behalf, but they must submit proof of authorization. We may deny requests if proof is inadequate. We will not process privacy requests from third-party services that have not passed our verification process; such services are susceptible to spoofing and phishing, and often request that we follow hyperlinks, which we will not engage due to security concerns. If an applicable State Privacy Law allows third-party agents for privacy requests, they must contact us directly using the information in the Contact Us section.

Responses to Requests. We endeavor to respond within 45 days. If more time is needed (up to 90 days), we will provide written notice of the reason for the extension. Responses will be delivered by mail or electronically, and if we cannot comply with a request, we will explain why. For data-portability requests, we will provide your Data in a readily usable electronic format. We may charge a fee if we find requests to be excessive, repetitive, or unfounded; if so, we will explain why and provide a cost estimate before completing the request.

G. Right to Opt Out of Automated Profiling Resulting in Legal or Similarly Significant Effects

Consumer residents of certain states have the right to opt out of the automated processing of their Personal Data for profiling in furtherance of decisions that produce legal or similarly significant effects, such as the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunities, criminal justice, employment opportunities, health-care services, or access to essential goods or services. Funambulist does not make decisions based on algorithms, automated decision-making, automated processing, or profiling that produce legal or similarly significant effects concerning you.

H. Do Not Sell or Share My Personal Data – Opt-Out Rights

Your State Privacy Law may provide the right to opt out of the sale or sharing of your Personal Data and the right to opt out of the use of Personal Data for targeted advertising or cross-context behavioral advertising.

We do not sell Personal Data for monetary or other valuable consideration. We use social media advertising, marketing pixels, cookies, analytics, and similar technologies for marketing, advertising, measurement, and analytics, and some State Privacy Laws may treat these practices as a sale, sharing, targeted advertising, or cross-context behavioral advertising. Our Site uses a consent-management platform to gate tracking and advertising technologies behind user consent and to recognize and honor opt-out preference signals, including GPC. You may also exercise applicable opt-out rights by contacting us using the methods in the Contact Us section.

We disclose some Personal Data to service providers, vendors, affiliates, subsidiaries, customers, and business partners to support our Services and operations, including to process payments, manage the Site, host and process Data, support marketing and advertising, provide analytics, ship or print materials, manage customer support, maintain business records, and comply with legal, tax, and regulatory obligations. See Section 16.C above.

We may collect information considered “sensitive” under State Privacy Laws, including Social Security numbers where applicable, driver’s license numbers, financial account information, bank account and routing information, account credentials, and chat contents where those contents include sensitive information. We do not use or disclose sensitive Personal Data for the purpose of inferring characteristics about you, and we do not sell sensitive Personal Data.

I. Right to Non-Discrimination and No Retaliation

The State Privacy Laws provide consumers the right not to be discriminated against for opting out or exercising privacy rights. Unless permitted by applicable State Privacy Laws, we will not deny goods or Services; charge different prices or rates (including through discounts or penalties); provide a different level or quality of goods or Services; or suggest that you may receive a different price, rate, level, or quality of goods or Services. We do not currently offer a financial-incentive program based on the collection, retention, sale, or sharing of Personal Data. If we later offer such a program, we will provide the required terms and obtain consent where required.

17. Supplemental Notice to California Residents
California Civil Code Section 1798.83 permits California residents who have a business relationship with us to request certain information regarding our disclosure of Personal Data to third parties for their direct-marketing purposes. To make such a request, please email us or write to us using the contact information in the Contact Us section of this Notice, and state that you are a California resident.
18. Supplemental Notice to Nevada Residents
Nevada Rev. Stat. Sec. 603A.345 permits consumers in Nevada to opt out of the sale of certain kinds of Personal Data. A sale under Nevada law is the transfer of Personal Data to third parties for monetary consideration so that those third parties can then re-sell or license the sold Data. We do not sell your Personal Data to third parties as defined under Nevada law.
19. Updates to this Notice
We may change this Notice from time to time, so please check back periodically. If we make changes, we will notify you by updating the Effective and Last Updated dates at the top of this Notice. If we significantly change our collection, use, or disclosure practices, we may provide additional notice, such as by adding a statement to our home page, sending you a notification, or sending an email if you have provided us with an email address. Some Services mentioned in this Notice may not be immediately available on the Site at this time.
